hall stead and rodney fong. i learned we all work closely as a team to get to the vision you heard everybody mention. i'm really excited today to be on the port commission because there is truly a renaissance going on up and down the waterfront including projects like this which will provide beautiful public access and all the other things that are going on. i can't think of a more exciting time to be involved with the city and the waterfront and to be on the port commission. so, i just want to recognize and thank also the port staff. there are many of them here today, monique and her staff, and we have members in the development and real estate and i think again it takes tremendous amount of teamwork to make these things happen. and i think again, that is my message to thank everybody. thank you very much. [applause] it is about time. i want to thank francis and fong. i think this is the very first statewide heritage month held with the mayor of san francisco. let me say something about heritage month in san francisco and your mayor. in the old days, you remember san francisco was known for passing all of these anti- chinese ordinances to limit the movement, the productivity of chinese in the city. we know two things. change happens. maybe the state of california is the state of golden opportunities, where we have a chinese-american mayor of san francisco. 35 years ago, congress members passed similar resolutions in both house and the senate to formally recognize the first 10 days of may as asian-pacific heritage week. one year later, president jimmy carter signed into law a joint resolution to officially designate the annual celebration. 11 years later, president george bush extended the weeklong celebration to an entire month. you know and i know that our mothers say that every day is asian pacific american day.

afternoon commissioners, president fong. i am john gold man and i presented at your two previous meetings and i am here again. presented ideas of grandfathering in certain projects. we are the architects and we designed to the building to reflect the concerns and there are studio apartments along 11th and the two bedrooms are away from 11th and we designed the building to meet a kooftic requirements so there is no sound transfer so i am here to reiterate again with proper design and unit mix and arrangement and acoustic design and i like the idea of it on 11th as long as you can do that and the night time times are great and our project which has been in submittal for seven years and we didn't proceed because we wanted to piggyback on the eir that was approved today after seven years ago. there was never reason for me to do that and get my own project going so what i want to emphasize here and cory teague and presented today and do no harm. that's fundamentally under mined this process for the last seven years. if you don't grandfather in the project it would definitely do harm to my

, president fong and members of the commission. my name is sarah jones,. i'm from the environmental planning division of the planning department. what i am doing today is giving a brief overview of the materials that you received this afternoon. those include a cover memo, some case studies on projects that were appealed. there were also appeals filed since 2010, a list of time frames -- a list of time frames for appeals as well as the department's responses to the comments that we've received thus far on the legislation. * results these materials were prepared in response to requests for information from commissioners. so, i'm mainly going to focus on the cover memo. what we did in that cover memo was broke down the proportion of time that the appeal process takes relative to other portions of the environmental review process for each major type of environmental document. this turned out, actually, to be a very helpful exercise for us because it really highlighted that the most problematic aspect of the current situation is the lack of predictability and clarity with regard to negative dec

[speaker not understood]. thank you. >>> president fong, commissioners, matt reagan with the bay area council. we're a business sponsored public policy advocacy organization. we do a lot of research on the health of the region's economy. one of the key factors we have constantly come to our attention is that the qualitiv of our environment here in the bay area is key, is a very key factor to maintaining our economic health and vitality. we need strong economic -- sorry, environmental protections and regulations. we have come to the conclusion that c-e-q-a provides none of that. c-e-q-a is a law that is for all intents and purposes obsolete. some of the people who spoke before me mentioned that many, many federal and state statutes that have been passed since c-e-q-a was written into law in 1970, that duplicate what c-e-q-a does. all of c-e-q-a currently does is absent those additional protections is put in place a very lengthy process for review and a very low threshold for litigation. that low threshold for litigation invites bad players into the process. if you look at who sues proj

chief starting with every chief has asked for tasers, including fong, and temporary chief, and go down and now chief sure. and in each of the cases i think that those discussions were precipitated by an officer-involved shooting that in the hearts and minds of our chief of this organization and looked at the facts of that and said that if we have a different weapon system and a electronic weapon control system we would not have to have deployed that force and in this case with the chief sure and i completely concur, that the shooting in july, that had we had a electronic weapon system in place and that person would be alive today and back to the road to recovery. and i think that is conist ent and the reason behind the chiefs bringing this discussion to bear. >> just hearing that i am reminded of when officer... was shot and he was shot by an officer, he said that he thought that he had a taser. and would be applying that. so i don't see it as necessarily as an equation that necessarily equates to the officer-involved shootings and we also have the experience of settled and so we do on

president fong members of the commission. i am andreas conterrace. i am with the planning department. this is the eir for the western soma community plan, rezoning of adjacent proposals and the project. a copy of the draft eir certification motion was distributed with you with the standard document. the draft eir was published on june 20, 2012 and the public hearing was held and public comment closed and the responses document was distributed and published on november 21, 2012. you also have before you a e rata street that has revisions in the environmental documents. there are extras copies on the side table for the public. these represent corrections in the e ie.d r and comments and responses document. these text changes do not present any new information that would awlter the conclusions presented in the draft eir and these changes below do not need to trigger to recirculate the eir based on the california environmental act. these corrections include proposed height and bulk district where we have stated 65k or 65x in the eir. the text should read 65b so that is a correcti
